Waste Disposal Mayfair Terms and Conditions

These Terms and Conditions govern the provision of waste disposal and collection services by Waste Disposal Mayfair to domestic and commercial customers. By placing a booking with us, you agree to be bound by these Terms and Conditions. Please read them carefully before using our services.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

Customer means the person, company or organisation booking waste collection or related services from Waste Disposal Mayfair.

Services means waste disposal, waste collection, rubbish removal, recycling, clearance or any other related services provided by Waste Disposal Mayfair.

Waste means any items, materials or substances that the Customer asks Waste Disposal Mayfair to remove, subject to applicable waste regulations and any exclusions set out in these Terms.

Agreement means the contract between the Customer and Waste Disposal Mayfair incorporating these Terms and Conditions and any written confirmation issued to the Customer.

2. Scope of Services

Waste Disposal Mayfair provides waste collection, rubbish clearance and related services in its service area, which includes Mayfair and surrounding locations, as notified from time to time. Services may include the collection and transport of household waste, commercial waste, bulky items, recyclable materials and other non-hazardous waste streams.

The exact scope of the Services for each booking, including the type and estimated volume of waste to be collected, the location, timing and any specific instructions, will be agreed at the time of booking and set out in the booking confirmation provided to the Customer.

Waste Disposal Mayfair reserves the right to amend or refine the scope of Services offered in its operational area and may refuse or discontinue any service that cannot be completed safely, legally or within reasonable operational limits.

3. Booking Process

Customers may request a booking by telephone, email or via such other channels as Waste Disposal Mayfair may make available from time to time. All bookings are subject to availability and acceptance by Waste Disposal Mayfair.

When making a booking, the Customer must provide accurate information regarding:

1. the collection address and access details;

2. the type, approximate volume and nature of the waste to be removed;

3. any time constraints or site restrictions, such as parking or loading limitations;

4. contact details for the person responsible on site.

Waste Disposal Mayfair may provide an estimate based on the information supplied by the Customer. The final price may be adjusted on site if the actual volume, weight or type of waste differs from that described at the time of booking.

A booking is only confirmed when Waste Disposal Mayfair issues a booking confirmation notice, which may be provided verbally or in writing. By confirming the booking, the Customer agrees to these Terms and Conditions and to pay any applicable charges.

4. Access and Customer Obligations

The Customer must ensure that Waste Disposal Mayfair operatives have safe and reasonable access to the collection point at the agreed time. This includes arranging any necessary parking permissions, providing clear instructions and ensuring that the waste is accessible without undue delay.

The Customer is responsible for:

1. ensuring that the waste is presented in a safe condition for collection;

2. segregating waste types where required, such as recyclable and non-recyclable materials;

3. informing Waste Disposal Mayfair of any hazardous, sharp or heavy items that may require special handling;

4. complying with any reasonable instructions given by Waste Disposal Mayfair operatives on site.

If access is restricted or if the collection cannot be completed due to the Customer's failure to meet these obligations, Waste Disposal Mayfair may charge a call-out fee or a proportion of the agreed fee to cover wasted time and costs.

5. Waste Types and Exclusions

Waste Disposal Mayfair collects common household and commercial waste, including general rubbish, bulky items, furniture, non-hazardous construction waste and recyclable materials, subject to applicable regulations.

Certain waste types are restricted or excluded from the Services, including without limitation:

1. hazardous waste, such as chemicals, solvents, asbestos, medical waste or pressurised containers;

2. liquids, oils, fuels or substances that may leak or spill during transport;

3. waste that is prohibited by law from being collected, transported or disposed of without specific licences or consents.

The Customer must inform Waste Disposal Mayfair in advance if any potentially restricted waste is to be included in the collection. Waste Disposal Mayfair reserves the right to refuse any waste item that it reasonably considers unsafe, illegal or unsuitable for collection.

6. Pricing, Estimates and Payments

Charges for the Services are generally based on factors such as the type and volume of waste, labour required, access conditions and disposal costs. Waste Disposal Mayfair may provide an estimate in advance based on the description provided by the Customer.

All estimates are indicative only and not binding where the actual waste differs from the description or where unforeseen circumstances arise on site. The final price will be confirmed before the collection is carried out and must be agreed by the Customer or the Customer's representative on site.

Unless otherwise agreed in writing:

1. payment is due immediately upon completion of the Services;

2. Waste Disposal Mayfair accepts common payment methods, which may include card payment, bank transfer or cash, as notified to the Customer;

3. commercial Customers may be offered account terms subject to credit checks and separate written agreement.

All prices are quoted exclusive of any applicable taxes or charges that may apply under UK law, which will be added to the invoice where relevant.

If payment is not received when due, Waste Disposal Mayfair may charge interest on the overdue amount at the statutory rate, together with any reasonable costs incurred in recovering the debt.

7. Cancellations and Amendments

The Customer may cancel or amend a booking by notifying Waste Disposal Mayfair as early as possible. Cancellation terms may vary depending on the timing of the notice:

1. if the Customer cancels more than 24 hours before the agreed collection time, no cancellation fee will normally apply;

2. if the Customer cancels within 24 hours of the agreed collection time, Waste Disposal Mayfair reserves the right to charge a cancellation fee to cover allocated resources and potential lost work;

3. if the Customer fails to provide access at the agreed time or does not appear on site, this may be treated as a late cancellation, and a call-out or cancellation fee may be charged.

Any amendments to the booking, such as changes to the volume of waste, address, or timing, are subject to availability and may result in an adjustment to the price.

8. Performance of Services

Waste Disposal Mayfair will use reasonable skill and care in providing the Services and will endeavour to complete collections at the agreed time. However, all times given for attendance are estimates and may be affected by traffic, access issues, adverse weather, or other circumstances beyond its reasonable control.

If Waste Disposal Mayfair is delayed or unable to perform the Services due to such circumstances, it will inform the Customer as soon as reasonably practicable and arrange an alternative time or, where necessary, cancel the booking with a refund of any pre-paid charges.

The Customer agrees that some disruption may be unavoidable when removing bulky or heavy items. Waste Disposal Mayfair will take reasonable care to avoid damage, but the Customer should protect flooring, walls, and fixtures where possible and remove any fragile items that may be at risk.

9. Liability and Limitations

Nothing in these Terms and Conditions limits or excludes Waste Disposal Mayfair's liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or any other liability that cannot be limited or excluded under applicable law.

Subject to the above, Waste Disposal Mayfair will not be liable for:

1. any loss of profit, loss of revenue, loss of business, or loss of opportunity;

2. any indirect or consequential loss or damage;

3. any loss or damage arising from inaccurate information provided by the Customer;

4. any delay or failure caused by events outside its reasonable control, including traffic, weather, or third-party actions.

Where damage occurs to property as a direct result of Waste Disposal Mayfair's negligence, its liability shall be limited to the reasonable cost of repair or replacement, subject to an overall cap equal to the total fees paid by the Customer for the specific service during which the damage occurred.

The Customer is responsible for ensuring that any items requested for removal are not required for future use and have not been pledged, leased or otherwise encumbered. Waste Disposal Mayfair accepts no liability for items that the Customer or their representative has mistakenly presented as waste.

10. Customer Indemnity

The Customer agrees to indemnify Waste Disposal Mayfair against any claims, losses, damages, costs or expenses arising out of:

1. any breach by the Customer of these Terms and Conditions;

2. the inclusion of hazardous or prohibited waste in any collection without prior written agreement;

3. any injury or damage caused by unsafe access conditions or by items provided for collection that the Customer knew or ought reasonably to have known to be unsafe.

11. Compliance with Waste Regulations

Waste Disposal Mayfair operates in accordance with relevant UK waste management and environmental regulations, including requirements relating to the transport, handling and disposal of controlled waste. The company endeavours to divert waste from landfill where commercially and technically reasonable, including through recycling and other lawful disposal routes.

The Customer acknowledges that certain types of waste are subject to specific regulatory controls and may require documentation such as waste transfer notes. Where such documentation is required, Waste Disposal Mayfair will prepare or assist in preparing it, and the Customer must provide all necessary information to ensure its accuracy.

The Customer must not request or require any service that would involve a breach of applicable environmental or waste legislation. Waste Disposal Mayfair reserves the right to refuse any instruction that it reasonably believes would contravene such laws or regulations.

12. Data Protection and Privacy

Waste Disposal Mayfair will process personal data in accordance with applicable UK data protection legislation. Personal information collected from Customers will be used to manage bookings, deliver services, process payments, respond to queries and meet legal obligations.

Waste Disposal Mayfair may retain records of transactions and communications for a reasonable period for accounting, operational and regulatory purposes. Customers have certain rights in relation to their personal data, including the right to access and correct information held about them, subject to legal limitations.

13. Complaints and Dispute Resolution

Waste Disposal Mayfair aims to provide a professional and reliable waste collection service in its operating area. If the Customer is dissatisfied with any aspect of the Services, they should contact Waste Disposal Mayfair promptly with full details of the issue.

Complaints will be investigated and Waste Disposal Mayfair will endeavour to resolve them amicably and within a reasonable time. Where a complaint is upheld, Waste Disposal Mayfair may, at its discretion, offer a remedy such as a partial refund, a price adjustment or a repeat service.

14. Variations to Terms

Waste Disposal Mayfair may amend these Terms and Conditions from time to time to reflect changes in law, operational requirements or business practices. The version in force at the time of the Customer's booking will apply to that particular Agreement.

Updated Terms may be provided on request or made available through Waste Disposal Mayfair's usual communication channels. Continuing to use the Services after any changes take effect constitutes acceptance of the updated Terms.

15. Severability

If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable by a court or competent authority, that provision will be severed from the remaining provisions, which will continue to be valid and enforceable to the fullest extent permitted by law.

16. Governing Law and Jurisdiction

These Terms and Conditions, and any dispute or claim arising out of or in connection with them or their subject matter or formation, shall be governed by and construed in accordance with the laws of England and Wales.

The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter or formation.

17. Entire Agreement

These Terms and Conditions, together with any booking confirmation and any additional written terms agreed between Waste Disposal Mayfair and the Customer, constitute the entire agreement between the parties in relation to the Services and supersede any prior discussions, correspondence or understandings.

The Customer acknowledges that they have not relied on any statement, promise or representation made or given by or on behalf of Waste Disposal Mayfair that is not set out in these Terms and Conditions or in the written booking confirmation.

By confirming a booking with Waste Disposal Mayfair, the Customer confirms that they have read, understood and agree to these Terms and Conditions.
